Supreme Court To Rule On Tsikata’s SALL Review Application On March 30

The Supreme Court has fixed March 30, 2021, to rule on a review application, which gave the Electoral Commission the go ahead to gazette John Peter Amewu, as the Member of Parliament for the Hohoe constituency.

The court presided over by Justice Yaw Apau fixed the date after Mrs. Grace Ewool, Chief State Attorney and Mr Tsatsu Tsikata had argued their cases.

Mr Tsikata who represented the residents of Santrokofi, Akpafu, Likpe and Lolobi contended that the apex court of the land fundamentally erred when it quashed the decision of the Ho High Court, which granted an injunction to the residents of the areas in dispute.

He contended that the apex court breached the fundamental human rights of the residents when it quashed an order by the Ho High Court which had placed an injunction on the Electoral Commission from presenting Mr Amewu as MP-elect for Hohoe.

Mrs Ewool opposed the review application and relied on the January 5, 2021 statement of case filed by the state.

According to her, the issues raised by Mr Tsikata had been determined by the Supreme Court and counsel was only rehashing those arguments.

Mrs Ewool said counsel for SALL had also raised no new and important issues to warrant the grant of the review application.

She said the only issue that ought to be considered was ground eight of Mr Tsikata’s review application.

On January 5, this year, the five-member panel of the court presided over by Mr Yaw Appau in a unanimous decision, held that the Ho High court erred in granting the order since it did not have the jurisdiction to do so.

The court held that while the Ho High Court’s decision was about election petition, the original case, which invoked the jurisdiction of the court was about human rights violations.

It noted that it was, therefore, strange the court orders were about Amewu’s election rather than the denial of the right of the people of SALL to vote.

It, therefore, annulled all the proceedings of the court’s sitting by Justice George Buadi, which granted the injunction freezing the gazetting of Mr Amewu.

The Ho High Court on December 23, 2020, granted an injunction aimed at preventing the EC from gazetting John Peter Amewu as the MP-elect.

The applicants had insisted they had been denied their rights to vote in the Hohoe constituency after the creation of the Oti Region, which warranted the creation of a new constituency.

The apex court also held that the order given by the court on December 23, last year, as of January 5, 2020, was non-existent since the 10 days injunction granted by the court had elapsed.

“Our jurisdiction does not extend to the C.I. 128, guiding the conduct of the Electoral Commission. It is the EC who must correct the issue regarding the Buem constituency.

“Whether they [People of SALL] should vote at the Buem constituency is not the issue before us. It is a matter between the interested parties and the Electoral Commission.

“If the interested parties were denied the right to vote, what has that got to do with the gazetting of the Hohoe MP-elect? He is not an agent of EC neither did he perform any decision for the EC, so why should he be the point of discussion?”

“If the contention of the SALL people is that Amewu was not duly elected because of infractions, that would have been different, but that is not the case here,” Justice Appau said.

Among other things, the Attorney-General was also seeking a prohibition order to prevent the Ho High Court from hearing the substantive case of disfranchising the people of SALL.

But the court tossed that up and gave Justice Buadi the right to continue hearing the rest of the case, which relates to the alleged human rights violations.

Akufo-Addo Threatens To Sack Ministers Over Flagbearer Campaign

President Akufo-Addo has threstened to kick out ministers in his government who continue to engage in flagbearer campaign activities few months into his second term.

Disclosing this on Asaase Radio, the New Patriotic Party (NPP’s) General Secretary, John Boadu said “President Akufo-Addo, in his capacity as the President of the Republic of Ghana, has made it clear that anybody that he finds to be distracting his government as a result of his or her ambition, he would not hesitate in getting them out of his government, so that they can concentrate on their presidential ambition or whatever.

“Sometimes it is very difficult for me to talk about these things but it looks like that is what we are to do. So we are putting forward some proposals to the [NPP] National Steering Committee quickly by this month we would be at a National Executive Committee to fashion out some guidance in order to allow government work to go on.”

“What it means is that it would get all and sundry to understand that there is no point in testing waters now whether by their assigns or by they themselves or whoever and there would be very punitive sanctions if one decides to disobey such a measure”, Mr Boadu noted.

Court Finds Akuapem Poloo Guilty Over Naked Picture With Son

The Accra Circuit Court has convicted actress, Rosemond Brown, popularly known as, Akuapem Poloo after she admitted guilty on her own plea.

Akuapem Polo who has been charged with publication of nude pictures with her seven-year-old son earlier pleaded not guilty when she was first arraigned, but changed her plea on Wednesday.

According to a report by Starrfm, the accused person pleaded guilty to all three charges and was convicted on her own plea by the court presided over by Her Honour Christina Cann.

EIB Network’s Court Correspondent Murtala Inusah reports that the court has deferred her sentencing to Friday, April 16, 2021, for her to undergo a pregnancy test in compliance with the law regarding a woman who has pleaded guilty in court.

Meanwhile she has been remanded into custody for the prosecution to take her to any Government hospital to conduct the pregnancy test.

‘4 More To Do More Dumsor’ – Yvonne Nelson Expresses Disappointment In Akufo-Addo

Actress Yvonne Nelson has expressed disappointment in President Akufo-Addo after the recent power outages that has bedeviled the country.

In a series of tweets, she expressed unhappiness over how dumsor is  resurfacing five years after her vigil against the erstwhile John Dramani Mahama administration, although the authorities are downplaying the seriousness of the situation.

Using the governing New Patriotic Party’s (NPP) 2020 campaign slogan of “4 more to do more”, mocked: “4 more to do more Dumsor”.

She called on President Nana Addo Dankwa Akufo-Addo to fix the problem, adding: “Never did Ghanaians think you’d let us experience dumsor”.
