The Supreme Court is set to continue its proceedings today, Monday, November 11, on a high-profile case concerning the potential removal of four Members of Parliament (MPs) elected as independents in the most recent general election. This hearing follows an adjournment that occurred on October 30.
In a prior session, Chief Justice Gertrude Torkornoo directed Speaker of Parliament Alban Bagbin to submit essential documents by Wednesday, November 6, after the Speaker’s legal representative, Thaddeus Sory, requested additional time to consult with the Speaker and obtain the necessary guidance for the case.
Attorney General Godfred Dame previously argued that the Speaker of Parliament should not be involved in the proceedings. Dame emphasized that the Attorney General’s office is vested with the authority to represent public officials in matters concerning constitutional interpretation and that the Speaker’s participation is therefore unnecessary. Based on this stance, Dame urged the court to proceed with its examination of the constitutional dimensions of the case without the Speaker’s involvement.
As the court reconvenes, all eyes are on how it will interpret and rule on the constitutional issues surrounding the MPs’ positions and the Speaker’s role, which could have significant implications for parliamentary representation and the powers of independent candidates in the legislature.
