The Supreme Court has sustained parts of an objection raised by lead counsel for the 2nd respondent in the ongoing election petition, Mr Akoto Ampaw to have portions of Mr Asiedu Nketia’s witness statement struck out because it is scandalous and prejudicial.
After close to two hours of legal arguments by Mr Akoto Ampaw, counsel for the 2nd respondent, and Mr Tsatsu Tsikata, counsel for the Petitioner, the Court presided over by Chief Justice Kwasi Anin Yeboah rose to consider their ruling.
Delivering their ruling, the court sustained the objection for parts of the statement to be struck out in totality on the grounds that they were not captured in the petitioner’s pleadings.
The court however, also overruled parts of the objection, maintaining sections of Mr Asiedu Nketia’s witness statement because they believed they were adequately contained in the pleadings.
