NDC Officially Files Appeal Over Assin North Ruling

The opposition National Democratic Congress (NDC) has officially filed a notice of appeal at the Cape Coast High Court over the annulment of the results of the 2020 Parliamentary Elections in the Assin North Constituency.

The court presided over by Justice Kwasi Boakye, ordered for fresh elections to be conducted in the Assin North constituency.

The case of the petitioner is that the MP at the time of filing to contest the 2020 parliamentary elections, had not renounced his Canadian citizenship and thus held dual nationality.

Handing his judgement on Wednesday, the judge said the MP, Joe Gyaakye Quayson violated constitutional provisions and other statutory provisions that guide Ghana’s elections.

The NDC in its notice to the Court’s registrar, cited discontentment and errors by Justice Boakye in delivering that judgement.

“The High Court erred in law when it held that an election petition in the High Court is a competent procedure for challenging the decision of the [EC] to clear [the MP] for the 7th December, 2020 Parliamentary election,” one of the grounds of appeal noted.
