Mahama Petitioned To Remove Jean Mensa And Deputies Over Alleged Misconduct

Citing Article 146 of Ghana’s 1992 Constitution, the petitioner argues that the EC Chairperson and her deputies have violated key provisions of the constitution, including Articles 42, 46, 23, and 296. These articles pertain to the conduct of public officers, the protection of fundamental human rights, and the exercise of discretionary power. The petition asserts that the officials’ actions and inactions have not only undermined the integrity of the EC but also pose a significant threat to the fairness and transparency of Ghana’s electoral process.

A formal petition has been filed with the Office of the President of Ghana, seeking the removal of the Chairperson of the Electoral Commission (EC), Jean Mensa, along with three other high-ranking officials of the commission. The petition, submitted on Monday, January 27, 2025, by Ofosu-Appiah Daniel, accuses the EC leadership of constitutional violations, incompetence, bias, and actions that have significantly undermined public trust in the electoral body.

The petition also targets Dr. Bossman Asare, Deputy Chairperson in charge of Corporate Affairs; Samuel Tettey, Deputy Chairperson in charge of Operations; and Dr. Peter Appiahene, a member of the EC’s board. The petitioner alleges that these officials have engaged in gross misconduct, breached human rights, and demonstrated incompetence in the execution of their duties. These actions, according to the petition, have eroded the credibility of the Electoral Commission and compromised its constitutional mandate.

The petition asserts that the officials’ actions and inactions have not only undermined the integrity of the EC but also pose a significant threat to the fairness and transparency of Ghana’s electoral process.

“By these actions and inactions, the Chairperson and her deputies have breached their constitutional duties and jeopardized the trust of the Ghanaian people in the electoral system. Their continued presence in office is a risk to the democratic process,” the petition states.

The petitioner is urging the Office of the President to take immediate action to address the matter, emphasizing the need to restore public confidence in the Electoral Commission. The petition highlights the critical role of the EC in safeguarding Ghana’s democracy and calls for accountability to ensure free, fair, and credible elections in the future.

This development comes at a time when public trust in electoral institutions is paramount, and the outcome of this petition could have far-reaching implications for Ghana’s democratic governance. The Office of the President is yet to issue an official response to the petition.
