You Can’t Charge Any Money You Want – Kwaku Azar Fumes At EC’s ‘Unlawful’ Filing Fees

Law professor and activist, Professor Kwaku Asare, popularly known as Kwaku Azar has slammed the Electoral Commission for demanding exorbitant fees from Presidential candidates ahead of the 2020 polls.

In a post on Facebook, Mr Azar described the increase in cost of filing fee as ‘unlawful’insisting government agencies are fully funded to provide services to the public hence they cannot just charge the public whatever they want.

Government agencies are fully funded to provide services to the public. As such, they cannot just charge the public whatever they want for whatever reasons.

ACT 983 provides for the regulation of their fees and charges and for related matters.

Under the Act, to charge at all, first these agencies, including the EC, must publish regulations, which, of course, has to be placed in Parliament where it undergoes vetting.

CHRAJ cannot wake up and start asking us to pay ?50,000 per complaint to weed out non-serious complaints any more than the EC can ask general election candidates to pay ?100,000 to get on the ballot.

It has to publish regulations, which Parliament, under pressure from the people, will reject.

Some say the EC can charge whatever it wants to weed out non-serious candidates.

I say show me someone who voluntarily hands over his or her hard earned ?100,000 to the EC, without asking for the authority of the EC to impose that tax or penalty, and I will show you someone who will be a bad steward of the public purse.

By the same token, the EC cannot levy a registration tax on voters to weed out non-serious ones.

The EC is not a tax collector, a for profit-entity, a seriousness inspector or in any way set up to impose charges, let alone excessive ones, on general election candidates.

Rather, its task includes making sure political parties timely file their financial reports and making same available to the public for vetting.

Its task is to get dirty money out of our politics not exacerbate the problem.

In short, fiats to impose fees are not just corruption-enhancing and discriminatory against the poor, they are also unlawful.

EC Boss Reveals How Some Names Got Omitted From The Voters’ Register

Electoral Commission chair, Mrs Jean Mensah has explained how some names were omitted from the current voters register.

Addressing the press Monday, September 28, 2020, Mrs Jean Mensah said a process to export the information of registered voters onto secured storage is to blame for the missing names in the register.

“Registration of voters is done using Biometric Registration Devices at the Polling Stations. Thereafter, the data is then transmitted to the data centre where it undergoes the process of de-duplication by the Automatic Biometric Identification System (ABIS).

“In other words, the data is exported for secure storage and further analysis. The provisional register is then produced. In a few instances, the process of exportation of data from the USB sticks to the central server was faulty leading to shortfalls of data in some areas

“It is important to highlight that although the registration process is IT-driven, there is still a significant amount of human involvement that may result in errors in every step of the process from registration to exhibition. In short, due to unintentional human and administrative errors, the process of exportation of data from the BVD kits to the USB sticks and then to the Central Database was in a few instances faulty leading to shortfalls in some areas. In a nutshell, our technology performed optimally as expected, however, in some areas, the human element of ours fell short leading to some of the gaps in the data we experienced,” she explained

Chief Backs Naana Agyeman And NDC To Win 2020 Elections

The Nkosohen of Atti-Morkwa Traditional Council in the Central Region, Togbe Gottah believes Prof. Naana Jane Opoku Agyeman and the National Democratic Congress (NDC) will emerge victorious in the December 7 polls.

Togbe Gottah says nothing can stop Prof. Opoku-Agyeman from becoming the first female Vice President of Ghana.

“Ghanaians have waited soo long to get female as a Vice President but thank God we have already gotten somebody and indeed she really deserves it,” he stated.

He urged his people to vote massively for the NDC party to return back to power and complete all stalled projects in the area which was initiated by the erstwhile Mahama administration.

Prof. Naana Jane Opoku Agyeman who visited the area as part of her campaign tour of the Region also called on the constituents to turn up in their numbers and vote for the NDC in the 2020 elections.

The General Secretary of the governing New Patriotic Party (NPP), John Boadu has said that the party will not tolerate independent candidates in this year’s elections.

The party will revoke the membership of such candidates who decide to go against the party rules to go solo in the 2020 general elections according to him.

Speaking on Okay FM’s ‘Ade Akye Abia’ Show, Mr. Boadu added that the party will also disown them should they even make it to Parliament.

He further appealed to disgruntled candidates to resort to the party’s constitution and other methods akin to the party’s constitution than to go independent which does not help in the development of a party that is seeking re-election.
