We Will Reopen Our Case And File A Subpoena To Force Jean Mensah Into The Witness Box – Tsikata Tells Supreme Court

Lead counsel for the petitioner in the 2020 election petition, Tsatsu Tsikata has notified the Court that his side will reopen their case in the ongoing election petition in order to file for a subpoena to force the chair of the EC into the witness box.

This was after the court, presided over by Chief Justice Kwasi Annin Yeboah overruled an objection made by Mr Tsikata after the 1st and 2nd respondents had elected not to call any witnesses.

In a ruling read by the Chief Justice, the Court is of the opinion that a party cannot be forced be mount the witness box on the basis that the said party has filed a witness statement.

According to the court, even though Mr Tsikata made a passionate appeal for the court to force the EC Chair into the box because she occupies an important public office, he could not point the court to any provision in the constitution that could force the court to grant his request.

The Court has therefore affirmed the pleas of the respondents not to produce any witnesses to adduce any evidence.

However, Mr Tsikata notified the court that his side intends to officially file a motion to reopen their case and file for a subpoena.
