Tsikata Vs Godfred Dame Case: All You Need To Know About The Judges Who Sat On The Case

Published

on

John Peter Amewu, the Member of Parliament-elect for the Hohoe Constituency can now be sworn-in as a lawmaker after being cleared by the Supreme Court.

The Apex court on Tuesday, January 5 quashed an earlier ruling by the Ho High Court which barred Amewu from partaking in the swearing-in of MP’s on January 6.

It was a unanimous decision by the five judges who held that Amewu could be sworn-in while the NDC challenges the substantial case of whether he was duly elected.

Below is a brief information about the Justices who sat on the case…..

Justice Clemence Honyenuga

In the context of this case, Justice Honyenuga is the most popular among the panel due to an application by Tsatsu Tsikata, the lawyer of the SALL communities to have him recuse himself.

Tsatsu Tsikata had suspected possible bias on the part of the judge and motioned for him to be removed but that was rejected.

It was not the first time Justice Honyenuga was caught in some controversy. He was once captured on tape endorsing Nana Akufo-Addo in his capacity as a chief.

This ruffled feathers in the NDC who called for him to be punished but he was rather nominated for the Supreme Court post and was subsequently approved by Parliament after undergoing vetting in May 2020.

Justice Gertrude Tokornoo

Justice Gertrude Tokornoo was the only female judge on the panel. She is alleged to have diffused the bias claims by Tsatsu Tsikata by asking him that since she has been eating at his house, should she also recuse herself since she has a relationship with him.

Justice Gertrude Torkornoo was nominated by President Akufo-Addo for the position in November 2019 and after being vetted on December 10 was sworn-in in December 2019.

She is also an author.

Justice Samuel Marful-Sau

Justice Samuel Marful-Sau is a former Court of Appeal judge who was nominated alongside three others by President Akufo-Addo in 2018.

His nomination came with some controversy as some people alleged that he was being rewarded for his alleged role in the removal of former EC chair Charlotte Osei.

The government rejected such claims and he was unanimously approved by Parliament.

Justice Amadu Tanko

Justice Amadu Tanko is arguably the most well-known of all the five judges as he spent a chunk of his lawyer days in the football industry.

His Lordship, Amadu Tanko got appointed to the High Court in 2008 and was promoted to the Court of Appeal after four years.

Amadu Tanko is the first Muslim to serve on the Supreme Court and was sworn-in on May 22, 2020.

Justice Yaw Apau

Justice Yaw Apau has been on the Supreme Court since 2015 when he was nominated by President John Mahama and subsequently approved by the Parliament of Ghana.

His appointment was welcomed with some controversy as critics alleged that he was being rewarded for doing the president’s bidding at the judgement debt commission.

He, however, denied those claims during his vetting in Parliament. He was an Appeal’s Court judge before becoming a Supreme Court justice.

Tsikata Files Another Motion At The Supreme Court Today Seeking To Amend His Earlier Processes – NPP Cries Over ‘Delay Tactics’

Lawyers for former President John Dramani Mahama have filed a fresh process at the Supreme Court seeking leave to amend earlier processes in the 2020 presidential election petition.

The new application was filed at the Supreme Court at 2:30pm on Monday, January 25, 2021.

The Supreme Court is due to hear the 2020 presidential election petition filed by Mr Mahama on Tuesday, January 26, 2021.

Ahead of the appearance in court Tuesday, Mr Mahama’s legal team filed another application at 2:30pm Monday seeking to further amend earlier processes.

The lead counsel for Mr Mahama, Mr Tsatsu Tsikata also intends to file and or argue an additional ground for his application for review filed on January 20, 2021.

One of the spokespersons for President Nana Addo Dankwa Akufo-Addo [2nd respondent] in the case, Mr Kojo Oppong Nkrumah who is also the Minister of Information designate thinks that “The effect is to occasion further delays in dealing with the five issues in the substantive matter. Its very unfortunate,” he tweeted.

EC Lawyers Support Tsatsu Tsikata As They Beg Supreme Court To Bring Forward The Hearing Of Petitioner’s Review

Published

on

Lawyers for the Electoral Commission (EC) in the election petition are in support of the hearing of the review of the ruling on interrogatories to be brought forward from Thursday, January 28, 2021, to Tuesday, January 26, 2021.

Their stance is in support of a similar motion by the petitioner in the case, John Mahama.

In a motion signed by Justin Amenuvor, the lead lawyer for the EC, he said the sole reason for the notice of abridgement of time for the application for review is to “facilitate an expeditious trial.”

“That the abridgement of time is necessary for a speedy determination of the motion on notice for review and any further orders this Honourable Court may deem fit,” he argued.

“In the circumstances, I respectfully pray that in the interest of justice and speedy determination of This matter, and in line with the timelines of CI 99 the hearing date for the motion on notice for review be abridged to the 26th January 2021 subject to the convenience of the Court.”

The interrogatories from the National Democratic Congress flagbearer, John Mahama, wanted answers to 12 questions as part of the pre-trial process.

But both the lawyers for the EC and President Akufo-Addo opposed the application.

They argued that John Mahama and his legal team were using the “back door” to seek further information from the EC that was not captured in their petition.

Mr. Akoto Ampaw, the lawyer for the President, further described the application as a “fishing expedition”.

The Supreme Court in a unanimous decision then dismissed the application prompting the motion for review.
