Delete All Negative Stories You’ve Written About Judges – Judicial Service to Media Houses

The Judicial Service has charged media houses to remove every story they’ve put on their various news portals that puts the images of judges in the ongoing election petition in bad light.

“The statements and speeches interfere with the due administration of justice as Justices of our client are threatened with ominous consequences following their decisions which do not meet the expectations of some members of the society,” a statement read.

“The statements and speeches bring the administration of justice into disrepute as unsuspecting Ghanaians are being deliberately misinformed and manipulated to believe that the justice system is perverted and lacking in credibility,” lawyers of the Judicial Service wrote to Media houses Friday.

The letter also urged editors to exercise the highest form of discretion when running stories about judges.

Below are details of the statement

RE: INCENDIARY, HATEFUL AND OFFENSIVE STATEMENTS AGAINST MEMBERS OF THE JUDICIARY.

  1. We write as solicitors for and on behalf of the Judicial Service of Ghana (simply referred to hereafter as “our client”) and upon whose instructions we write you this letter.
  2. We have been instructed by our client to communicate to you, and we hereby do, its concern regarding the lack of discretion and responsibility on the part of some Media Houses in Ghana.
  3. Our client’s concern arises from the publication and/or permitting the publication of a series of incendiary, hateful and offensive statements, and speeches on their various platforms against our client’s Justices.
  4. This concern has been heightened by the flurry of statements and speeches directed at our client’s Justices, especially after the commencement of the hearing of the election petition in the suit intituled John Dramani Mahama v. Electoral Commission & Nana Addo, numbered writ no J1/15/2021.
  5. The fact that these statements and speeches directly mention some of the Justices hearing the petition apart, a number of your publications directly insinuate that the decisions of the Justices presiding over the matter are motivated by factors outside legal principles and proper judicial consideration.
  6. The focus of the statements and speeches therefore patently insinuate that the decisions are motivated by matters unrelated to the rules and principles in accordance with which justice is delivered but are motivated by corrupt factors and devoid of any legal justification and/or reasoning.
  7. The point above made is vindicated by a very cursory reading of a number of the statements and speeches published on some of your platforms on the decisions of the Court with regards to the election petition most of which reveal without a shadow of a doubt that there is no attempt whatsoever to objectively analyse and discuss the Court’s decisions.
  8. Our client has instructed us to inform you and we hereby do, that publications of the kind published on your platform are dangerous to the Ghanaian society and our democracy as a whole not only because they obviously sow in the minds of the unsuspecting members of the public, false notions that the justice system is a sham and should not be trusted, but actually provides a foundation for lawlessness, as it clearly suggests to Ghanaians that they should no longer have confidence in the judicial system, with the following implications being obvious from such statements and speeches;
  9. The statements or speeches threaten our constitutional order and democracy as an important arm of government is being vilified and disparaged with impunity.
  10. The statements and speeches interfere with the due administration of justice as Justices of our client are threatened with ominous consequences following their decisions which do not meet the expectations of some members of the society.

iii. The statements and speeches bring the administration of justice into disrepute as unsuspecting Ghanaians are being deliberately misinformed and manipulated to believe that the justice system is perverted and lacking in credibility.

  1. Having said that, we have been instructed by our client to make it clear to you that whilst our client acknowledges that a large membership of the public are interested in the proceedings for which reason they are constantly following same and are permitted to express their views on the proceedings, it is unacceptable to publish on your platforms, speeches and statements and publications which excite anger, hate and passion against the Justices presiding over the election petition whose only involvement in the matter arises from their obligation to perform their constitutional duty of determining the dispute between the parties which must necessarily go one way or the other.
  2. Our client accordingly acknowledges the fact that in the delivery of justice, persons interested in the proceedings in one way or the other and who do not find the decisions of the courts favourable, are usually unhappy but hastens to add that in a civilised society such as ours, which is regulated by law, the expression of dissatisfaction with decisions of the courts must be dealt with in accordance with the same rules which accord persons the right to access the courts and no more.
  3. It must be added immediately that the right to free speech and discussion of judicial proceedings, decisions of the courts and the administration of justice is only legally permissible provided the criticism does not interfere with the due administration of justice especially whereas in this case it is intended to strike fear in the Justices whose constitutional mandate is to determine the petition and/or bring the administration of justice into disrepute and also threatens our constitutional democracy.
  4. Our client’s concerns above stated is justified when account is taken of the fact that Ghana’s history has singularly and despicably recorded the inhumane abduction and callous murder of Justices of the Superior Courts of the Judicial Service for which reason all and any acts and omissions which threaten officials of our client must be treated with the highest level of seriousness and dealt with according to the law which undeniably forbids such threats to the person and property of Justices of our client and also ensuring that the dignity and respect in which our client’s Justices duties are constitutionally encapsulated, is not undermined.
  5. We have particularly taken note of the fact that Justices of our client have in the discharge of their constitutional duties, affirmed, and enforced the right to free speech and by reason thereof, accommodated a reasonably wide latitude in so far as criticisms of the administration of justice is concerned the reason for which all judicial proceedings including the election petition, are conducted in public, thereby providing a platform for free public debate on the proceedings.
  6. In the light of the foregoing, we have our client’s instructions to demand, and we hereby so do that, as most responsible media institutions now do regarding incendiary and spiteful publications, you immediately.
  7. pull or cause to be pulled down and cleared from your platforms, all statements and speeches which convey and/or insinuate hateful, spiteful, vengeful and incendiary communication against Justices of our client especially those hearing the election petition.
  8. prevent the publication of such statements and speeches on your platforms, and

iii. forthwith exercise the highest level of discernment, discretion and responsibility insofar as the publication of statements and speeches regarding the administration of justice are concerned.

  1. Our client’s demand above communicated to you is made against the backdrop of the law which advises that where the population consists largely of uneducated or not very well-informed people, it is necessary to take a stricter view of what criticism may be allowed of the justice system, the reason being that although the administration of justice must suffer the respectful though outspoken [not inciteful, hateful or spiteful] comments of ordinary men, it must not be adversely interfered with and/or brought into dispute.
  2. We must notify you, and we hereby do, that should you fail to heed our client’s demand as specified in paragraph 14 above, we have our client’s instructions to take appropriate action to ensure that you do not abuse the right to free speech by deploying and/or permitting your platform to be deployed in a manner that not only threatens our constitutional order and democracy but obviously, adversely interferes with the due administration of justice and also, brings it, into disrepute.
  3. Please be advised.

NDC Issues Statement On Kasoa Murder; Calls On Akufo-Addo To Speed Up Probe Into Unresolved Crimes

The opposition National Democratic Congress (NDC) has in a statement commiserated with family of the ten-year old boy who was killed by two teenagers at Kasoa for ‘money ritual purposes’.

The statement called on President Akufo-Addo to as a matter of urgency speed up investigations into unsolved crimes in the country since he took over the wheels of power.

PRESS STATEMENT BY THE NATIONAL DEMOCRATIC CONGRESS ON THE MURDER OF YOUNG ISHMAEL MENSAH ABDALLAH AT KASOA.

It is with extreme shock and disbelief that the National Democratic Congress received news of the gruesome murder of a ten-year-old boy called Ishmael Mensah Abdallah at Kasoa in the Central Region by his own teenaged acquaintances for ritual purposes.

The Leadership, as well as the entire rank and file of the NDC, join the family and friends and, indeed, the entire nation, in mourning the loss of this young and promising boy much beloved by his family and community.

It is the expectation of the National Democratic Congress that the appropriate authorities will ensure that the bereaved family are comforted by the swiftness of the application of the law to punish the perpetrators and all who may be behind this dastardly murder.

The NDC has taken due notice of the fact that there appears to be a fashionable craze toward the acquisition of quick wealth by many of our countrymen and women and the youth in particular, without the attendant hard, morally sound and lawful means of obtaining same.

We deem this development as a dangerous trend that has to be condemned and discouraged by all and sundry.

It is a development which the NDC is unquestionably opposed to, or else we risk bequeathing to the youth, a practice and a lifestyle that cannot build this nation.

We further wish to draw the attention of the Akufo-Addo government to the plethora of crimes whose resolution has dragged on interminably, thus, encouraging the perpetuation of the culture of impunity.

We encourage the youth to look out for honest, hardworking, and accomplished persons as their role models.

Wealth which has been improperly obtained, should never be an attraction for the upcoming youth of this great nation.

In this regard, we call on the Akufo-Addo government to speed up investigations and crank the wheels of justice so that the country can rid itself of the odious reminder of this unfortunate event.

May the soul of young Ishmael Mensah Abdallah rest in peace.

World Homeopathy Day: Celebrating the Leading Fathers of Homeopathy in Ghana

10th of April is celebrated as “World Homeopathy Day” to make the immense contribution of homeopathy to medicine, all around the world. This day is observed on the birth anniversary of the founder of homeopathy, Dr Christian Friedrich Samuel Hahnemann who was a German born in Paris on April 10, 1755.

Dr Hahnemann, a distinguished scientist and scholar discovered the way to heal through the use of homeopathy—and his discovery, as well as methods, continue to serve humanity as a plausible complementary or alternative medicine.

As a complementary or alternative medicine, homeopathy is different from treatments that are part of conventional western medicine in many ways. A central principle of the “treatment” is that “like cures like” – that a substance that causes certain symptoms can also help to remove it.

Just like many other branches of medicine, homeopathy has faced criticism in the past and continues to face the same today, however, its usage across the world is growing with prominent figures such as Queen Elizabeth II and her successor-Prince Charles being users and benefactors of this form of alternative medicine.

In 2007, Prince Charles wrote to the then-health secretary of the UK-Alan Johnson complaining that people were “suffering unnecessarily” as a result of the minister’s “anti-homeopathy campaign”. In his letter, Charles stated, inter lia, that homeopathy “offers an holistic, patient-centred, low-risk, low-cost, low-tech approach” and that “for all these reasons it must surely make abundant sense to safeguard the HHs [homeopathic hospitals] in the interests of the nation’s health.” 

In March 2020, it was reported that Queen Elizabeth, 94 years, continues to rely on homeopathy to keep her well during the coronavirus outbreak. The Queen’s mother, who lived to 101 was also said to be a fan of homeopathy.

If the royal family of Great Britain and over 100 million people in India solely depend on homeopathy for their medical care as well as over 100 million citizens of the European Union use homeopathic medicines, then surely its acceptance and growing popularity in Ghana was inevitable.

In celebrating homeopathy today, its journey and now prominence in Ghana is worthy of reminiscing. The early practitioners such as Dr Adu Boateng whose End Point Homeopathic Clinic is a front industry runner in Ghana faced several obstacles (from individual acceptance to regulatory issues) during the introduction of this form of alternative medicine to the mass market in Ghana over a decade ago.

“Of course, there were people practising homeopathy in Ghana before I entered into practice over 10 years ago with End Point Homeopathic Clinic. However, these pioneers where practising a bit of everything in the sector of alternative medicine. Most of them had herbal medicine as their main area but delved into homeopathy too,” Dr Adu Boateng in an interview stated.

He continued: “It was a relentless struggle those days and it seems because a sole homeopathic practice was not in existence, the necessary regulatory framework was not developed—so all these had to come into force gradually and instituted by the government for us to get to where we are today as a country that has somewhat widely accepted homeopathy.”

With 5 branches across Ghana, Dr Adu Boateng and his End Point Homeopathy Clinic have successfully trained several homeopaths who have also established their clinics in Ghana—furthering his ultimate desire to bring homeopathy to the front doors of millions of Ghanaians.  

Commenting on the growth and acceptance of homeopathy and the future of alternative medicine in Ghana, Dr Adu Boateng stated that “it is refreshing to see more practitioners of homeopathy providing quality healthcare services in Ghana—but what is even more gratifying is the fact that treatments are working and more people are relying and trusting this form of alternative medicine.”

However, he cautioned the general public against patronizing the practices of non-quality and unqualified practitioners—saying, there are a few people who as would be expected of any industry are doing anything and calling it homeopathy.

“When it comes to a person’s health, it cannot be played with, therefore, Ghanaians should make sure that they are only using well established and trustworthy homeopathic clinics to ensure that they receive the deserving healthcare,” Dr Boateng said.

In celebrating this year’s “World Homeopathy Day,” End Point Homeopathy Clinic is offering free prostate screening for men—and free fertility testing for women at all its branches across Ghana for the month of April.
