The 2020 election petition is living up to its dramatic expectations as the counsel for the flagbearer of NDC, John Dramani Mahama, clashed with a Supreme Court judge.
The legal blows between Mr Tsikata and a Supreme Court Judge, Nene Amegatcher, began when he posed questions he claimed were key to discovering the ‘errors’ committed by the EC.
According to Mr Tsikata, the interrogatories (questions) were critical as it would help the apex court determine the authenticity of the results that saw the NPP presidential candidate, Nana Akufo-Addo, emerging as the winner of the 2020 polls.
But presenting the list of questions on Tuesday, Mr Tsikata made reference to the Electoral Commission Chairperson rather than the office that conducted the polls.
That did not sit well with Justice Nene Amegatcher.
The apex court judge insisted that the questions should be directed to the office of the Chairperson and not come across as a personal attack on Mrs Mensa.

TS: This is a question only one person in this world can answer
NA: Why wouldn’t you limit your references to the office rather than the personality. It seems to me that your attack is with the personality and not the office…We will be happy if you just limit it to the office and not the EC because in her absence any of her deputies could step in.
TT: Respectfully my lord, there is only one Returning Officer for the presidential election and that is the EC chairperson.
NA: let’s leave it at that, Chairperson of the Electoral Commission and not her person
TS: But my Lord, she is the Chairperson and she has a name, or I am not allowed to mention the name of the Chairperson
NA: The question should be to the office
TS: I want to understand, am I being prohibited from mentioning the name of the Chairperson, is that the issue?
NA: Reading through your petition which makes constant emphasis on the name, what I am telling you is that we will be satisfied with the designation because in her absence any of her deputies could act in that position
TS: My Lord…
NA: So, it is an election petition and you are challenging the election, it is sufficient that the institution charged with conducting the election had done their work and the Chairperson who is the head represents that institution and not the personality.
TT: With the greatest respect, I believe that the constitutional requirement regarding the returning officer and the particular circumstances do not make it possible for someone to step in for the Chairperson, it cannot be like you are envisaging.
NA: The institution had done the work and not the personality
TT: The particular circumstances that we are dealing with in this case, do not make it possible to have the situation that you are envisaging where you have somebody else step in for the Chairperson. The constitution makes the Chairperson and only that person the Returning Officer and in the circumstances of this case that Chairperson happens to be the person we referred to in the petition who undertook her responsibility in accordance with the constitution and legal situation that we have, I am not mentioning her name by targeting her individual…that is far from it. I do not target her when I mention her name as the person who declared the results, that is a fact.

Blame Yourself For Not Doing Your Work Properly In The Strong Room – Supreme Court Chastizes Kpessah Whyte And Mettle-Nunoo
The justices of the supreme court have told witnesses of Mr John Dramani Mahama in the election petition, Mr Rojo Mettle Nunoo and Dr Michael Kpessa-Whyte to blame themselves for abandoning their duties in the strong room during the final collation of the election results if their claims are to be believed.
During proceedings, the two witnesses told the court that they were sent by the Chair of the Electoral Commission (EC) to Mr Mahama at the time of the collation of the final results in the strong room. In their absence, the results were then announced.
Delivering the judgment on Thursday, March 4 the court said “…Notwithstanding all these allegations of misunderstandings with the chair of the 1st respondent in the strong room and the fact that they were absent during the declaration, they did not give any indication as to how these happenings in their absence affected the final results announced by the 1st Respondent.
“The testimonies would have carried some little weight if the purpose of the petition was to change entries made on the collation forms or summary sheets but that is not the case.
“Their testimonies were therefore of no relevance to the said issues set out for determination and so we find them unworthy for consideration whatsoever.
“In fact, regarding the testimonies of PW2 and PW3 , if their evidence is to be believed then they had to blame themselves for abandoning their post at the national collation centre at the time the verification and certification of the results were ongoing and PW3 had then verified and certified the regional collation results out of the 16.”
Breaking News: Supreme Court Unanimously Dismisses Mahama’s Petition As Having No Merit
The 7-member panel of the Supreme Court hearing the 2020 election petition have dismissed the 2020 election petition brought before the court by flagbearer of the NDC for the 2020 elections, John Dramani Mahama.
In an extensive verdict read by Chief Justice Kwasi Anin Yeboah, the court was of the opinion that the petitioner failed to disclose how the so-called errors by the EC chair materially affected the declaration.

The Petitioner in the 2020 election petition, John Dramani Mahama has made an appearance at the premises of the Supreme Court this morning.
The 7-member panel presiding over the 2020 election petition is expected to deliver judgement today in the case which lasted about one month.
Mr Mahama is challenging the declaration of President Akufo-Addo as having won the 2020 election.
According to Mr Mahama, no candidate obtained more than 50%.
He is therefore praying the court for a re-run of the election between himself and President Akufo-Addo.
The Apex Court will put the matter to rest today by delivering its judgement.
